Section 413Chapter XXXI
No appeal in petty cases
OF APPEALS
Notwithstanding anything hereinbefore contained, there shall be no appeal by a convicted person in cases in which 450[***] a Court of Session passes a sentence of imprisonment not exceeding one month only, or in which a Court of Session or 451[Chief Judicial Magistrate] 452[or Metropolitan Magistrate] or other Magistrate of the first class passes a sentence of fine not exceeding 453[five thousand taka] only.
Explanation
Explanation- There is no appeal from a sentence of imprisonment passed by such Court or Magistrate in default of payment of fine when no substantive sentence of imprisonment has also been passed.
